NOTARY, APOSTILLE, & COURIER SERVICES AGREEMENT
1. Mandatory Michigan Notary Disclosure
I AM NOT AN ATTORNEY LICENSED TO PRACTICE LAW IN THE STATE OF MICHIGAN. I DO NOT PROVIDE LEGAL ADVICE, DRAFT LEGAL DOCUMENTS, OR SELECT NOTARIAL CERTIFICATES FOR CLIENTS.
The Company and its representatives are strictly prohibited by Michigan law from providing legal counsel, drafting legal documents, selecting notary certificates, or advising on the legal sufficiency or destination requirements of any document. For legal or immigration concerns, please consult a qualified attorney.
2. Fees and Non-Refundable Policy
All fees for Michigan notary, courier, apostille routing, federal authentication, embassy legalization, and process serving are 100% non-refundable once processing has commenced. Payment is due in full prior to submission to any state, federal, or consular authority.
Government/Consular Delays: The Company acts strictly as an independent courier and processing agent. Delays, backlogs, or processing errors caused by the Michigan Secretary of State (Office of the Great Seal), the U.S.Department of State, or foreign embassies do not entitle the Client to a refund.
Client Errors: If a document is rejected due to inaccurate customer information, improper background checks, expired identification, or missing signatures, all fees remain fully non-refundable.
Consultation fee as well as cancellation and/or no-show fees are non-refundable. Client will have to rebook and pay fees again. Client must reschedule 24 hours before appointment (one time offer) or lose fee.
3. Third-Party Carrier & Shipping Waiver (Loss or Damage)
The Company frequently uses third-party shipping carriers (including, but not limited to, FedEx, UPS, DHL, and the United States Postal Service) to transport documents between state agencies, federal offices, and embassies.
No Transit Liability: The Company does not own or operate these transit services and has no control over their performance. The Company is not liable for any document that is delayed, misdelivered, damaged, stolen, or lost while in the custody of a third-party shipping carrier.
No Shipping Refunds: Shipping fees paid to the Company or to a carrier are completely non-refundable once the package is accepted by the carrier.
Replacement Costs: If a shipping carrier loses or destroys a document, the Client is solely responsible for procuring a replacement document and paying all subsequent processing fees to restart the authentication workflow.
4. Absolute Limitation of Liability (Hold Harmless)
The Client agrees to indemnify, defend, and hold harmless the Company and its individual notaries, process servers, or agents from any and all claims, lawsuits, damages, or financial losses.
Waiver of Lawsuits: The Client explicitly waives the right to sue the Company, its owners, or its employees for any error, omission, delay, loss, or destruction of documents.
Maximum Liability Cap: In the event that a court of competent jurisdiction within the State of Michigan finds this waiver or any part of this agreement unenforceable, the total liability of the Company for any single transaction shall never exceed the exact dollar amount paid by the Client to the Company for that specific service. The Company is never liable for indirect, incidental, or consequential damages (such as missed business deadlines, lost wages, or canceled international travel).
5. Michigan Document Retention & Unclaimed Document Fees
It is the Client's sole responsibility to pick up completed documents or provide an accurate, trackable return shipping label.
Holding Grace Period: The Company will hold completed or rejected documents for up to 14 calendar days after notifying the Client via email, text, or phone that they are ready for pickup.
Daily Storage Fee: If documents are not picked up or a return label is not provided within this grace period, a storage and handling fee of $10.00 per day will accumulate.
Abandonment & Secure Destruction: Documents left unclaimed after 60 calendar days will be deemed legally abandoned. To safeguard personally identifiable information (PII) and comply with privacy protocols, abandoned documents will be securely shredded and destroyed. The Client remains fully responsible for all outstanding service fees and accumulated storage costs.
6. Document Expiration & Accuracy
The Client certifies that all documents submitted meet the mandatory requirements of the destination country (e.g., ensuring Michigan local police or FBI background checks are within the required 90-day validity window). The Company is not responsible for verifying the expiration dates or content accuracy of the Client's paperwork.
